رسالة في المسح على الخفين للمؤلف محمد بن محمد بن مصطفى العمادي الحنفي ألو السعود دراسة وتحقيقا

يتناول هذا البحث دراسةً علمية وتحقيقًا أكاديميًّا لمخطوط فقهي نفيس في المذهب الحنفي، وهو «رسالة في المسح على الخفين» للمولى أبي السعود العمادي، أحد أعلام الفقه والقضاء في العصر العثماني. وتبرز أهمية هذا العمل لكونه يعالج مسألة من مسائل الطهارة ذات الأثر العملي، ويعكس منهج فقيه بارز له تأثير واسع في الفقه الحنفي. وقد انقسم البحث إلى قسمين رئيسين: القسم الدراسي والقسم التحقيقي. في القسم الدراسي تم التعريف بالمؤلف من خلال عرض سيرته الشخصية ومسيرته العلمية ومكانته بين فقهاء مذهبه، كما تم التعريف بالمخطوط بإثبات نسبته للمؤلف، وبيان مصادره، ووصف النسخ الخطية المعتمدة في التحقيق، وتحليل أسلوب المؤلف في عرض المسائل وأدواته الفقهية. أما القسم الثاني، وهو النص المحقَّق، فقد اشتمل على مقابلة النسخ المتاحة وترجيح أوجه الصواب وفق منهج التحقيق العلمي، وضبط النص وتخريج مسائله وتوثيقها من المصادر الفقهية المعتمدة، مع ترجمة الأعلام وذكر الكتب الواردة فيه، والإشارة إلى المواضع التي استدعت التعليق أو التوضيح. ويسهم هذا البحث في إبراز جانب من التراث الحنفي المخطوط، وإحياء نص فقهي مهم، وتقديمه بصورة علمية محكمة تعود بالنفع على الباحثين في الفقه وأصوله وتحقيق التراث. This research presents a scholarly study and critical edition of a valuable Hanafi manuscript entitled “Risālah fī al-Masḥ ʿalā al-Khuffayn” (A Treatise on Wiping over the Khuffs) by the eminent Ottoman jurist and judge Abu al-Suʿud al-ʿImadi (d. 982 AH). The importance of this work lies in its treatment of a practical jurisprudential issue related to purification, as well as in its reflection of the methodological approach of a distinguished Hanafi scholar whose influence extended widely within the school. The study is divided into two main parts: a descriptive and analytical study, and the critical edition of the text. The first part introduces the author by presenting his biography, scholarly career, and standing among Hanafi jurists. It also examines the manuscript by verifying its attribution, identifying its sources, describing the manuscript copies used in the edition, and analyzing the author’s legal reasoning and style. The second part presents the edited text, based on the collation of available manuscripts and the application of established principles of textual criticism. The text has been carefully verified, annotated, and documented with references to authoritative juristic sources, along with brief identifications of individuals and works mentioned in the manuscript. This research contributes to preserving and reviving Hanafi manuscript heritage and provides a reliable academic edition that may benefit researchers in Islamic jurisprudence, legal theory, and manuscript studies.
