وضع الجائحة بالسرقة وأثرها في الصداق في الفقه الإسلامي" دراسة فقهية"

بدأت الباحثة بحثها بالحديث عن مفهوم كل من الجائحة والسرقة والصداق، والألفاظ ذات الصلة بالجائحة ، ما يعد من الحوادث المتلفات جائحة، و مشروعية الصداق وأدلته، ثم تحدثت الباحثة عن الأسباب الفاعلة للجائحة، حكم وضع الجائحة ، وضعها بفعل السارق الذي يمكن معرفته وتضمينه، ووضعها بفعل السارق الذي لا يعرفه ولا يمكن تضمينه ، ضمان الصداق إذا كان الصداق في يد الزوج، وضمانه إذا كان الصداق في يد الزوجة، ووضع الجائحة إذا كان الصداق ثمرًا، ووضع زكاة الصداق عن الزوجة إذا أصابته جائحة بعض القبض. وتأتي أهمية الموضوع وسبب اختياره في : عرض ما اشتملت عليه الشريعة الإسلامية السمحة من مبادئ تقوم على إقامة روابط بين الناس على أساس التكافل والتضامن بين أفراد المجتمع. مكانة الصداق وارتباطه الوثيق بحال الفرد والمجتمع . مبدأ وضع الجوائح يعد أسلوبًا من أساليب تحقيق العدالة وصيانة أموال الناس الذي أصبح اليوم من ضروريات الحياة الاقتصادية. محافظته على استقرار العلاقات الاجتماعية بين الزوجين، ومنع النزاع بين أفراد المجتمع . The researcher began her research by discussing the concepts of pandemic, theft, and dowry, as well as terms related to pandemic, what constitutes a pandemic in terms of destructive events, and the legitimacy of dowry and its evidence. Then, the researcher discussed the effective causes of pandemics, the legal status of a pandemic, its status as a pandemic resulting from the actions of a thief who can be identified and held liable, and its status as a pandemic resulting from the actions of a thief who cannot be identified or held liable. Guarantee of the dowry if it is in the husband's possession, and guarantee of it if it is in the wife's possession. The dowry is subject to compensation for loss if it is in the form of produce, and the wife is required to pay zakat on the dowry if it is lost to a calamity after being received. The importance of this topic and the reason for its selection lie in: presenting the principles of Islamic law that establish bonds between people based on mutual support and solidarity within society; and highlighting the significance of dowry and its close connection to the individual and society .The principle of pandemic relief is a method of achieving justice and protecting people's money, which has become essential in today's economic life. It maintains the stability of social relations between spouses and prevents conflict among members of society.
