Abstract

This study examines the jurisprudential grounding (Ta’sil Fiqhi) of the prohibition regarding the sale of debt for debt (al-Kali’ bi-l-Kali’). It analyzes the Sharia rationales underlying this prohibition and compares its jurisprudential foundations with contemporary banking applications, specifically regarding debt restructuring and securitization. ‏The study adopts an inductive, analytical, and comparative methodology by surveying relevant texts and juristic opinions, and by analyzing the objectives (Maqasid) of the prohibition, which serve to block the means (Sadd al-Dhara’i’) leading to usury (Riba) and excessive uncertainty (Gharar). The research concludes that the prohibition of selling debt for debt is established by definitive consensus (Ijma’) and the Muslim community’s acceptance of the relevant Hadith. This acceptance reinforces its evidentiary validity, notwithstanding the weakness of its chain of narration (Isnad) from the perspective of technical Hadith criticism. ‏Furthermore, the study demonstrates that the central rationale for this prohibition is the prevention of an increase in debt in exchange for a deferment of time, which constitutes the very essence of pre-Islamic usury (Riba al-Jahiliyyah). The study determines that debt renewal (rollover) with an increase in the countervalue is definitively prohibited Additionally, the sale of debt to a third party (other than the debtor) involves significant uncertainty (Gharar) that renders it generally impermissible under Sharia law. Finally, the research establishes a set of Sharia parameters for contemporary applications. Most notably, these include the complete separation of the original debt from the new contract during refinancing, and the utilization of legitimate alternatives—such as a discount for early payment (al-Hatita) or refinancing through genuine, independent contracts—provided that the conditions of possession and Sharia-compliant ownership are strictly met.
