Abstract

This study examines the maxim “That without which an obligation cannot be fulfilled is itself obligatory” through an applied, analytical approach within the framework of Usūl al-Fiqh. It aims to refine the maxim’s methodological structure, precisely define its proper scope, and establish sound criteria for its application to juristic branches (furūʿ fiqhiyyah). The study proceeds from the observation that, despite the widespread use of this maxim, there remains scholarly disagreement regarding the determination of its operative cause (manāṭ), the distinction between what properly falls within its scope and what does not, as well as the differentiation between prerequisites of obligation (muqaddimāt al-wujūb) and prerequisites of existence or performance (muqaddimāt al-wujūd). The research adopts an inductive method in surveying the statements of Usūl scholars, a logical-analytical method in uncovering the rational structure of the maxim, a comparative method in examining differing opinions and preferring the strongest among them, in addition to an applied method in implementing the maxim in selected juristic cases. The study concludes that the proper scope of the maxim is restricted to what the existence and performance of an obligation depend upon after the obligation has been established, not to what the obligation initially depends upon. It further demonstrates that Usūl-based disagreement arises primarily with respect to matters external to the essence of the obligation, such as conditions and causes. The study also supports the majority view that whatever an obligation cannot be fulfilled without is obligatory in all cases where it lies within the capacity of the legally responsible person (mukallaf). This obligation, however, is derivative rather than independent; it is an existential, rational obligation inferred through implicative indication (dalālat al-iltizām), not a directly sought legal obligation nor a punitive one. Furthermore, the study clarifies that applying this maxim to juristic cases is valid only under precise conditions, most notably: the confirmed establishment of the original obligation, that the prerequisite be one of existence rather than obligation, the presence of a real (non-illusory) necessity, the realization of capacity, the determination of the specific prerequisite, and the absence of viable alternatives. The research ultimately proposes a disciplined applied analytical model, whose validity is demonstrated through juristic applications that confirm its effectiveness in regulating legal reasoning and preventing unwarranted expansion in the attribution of obligation.
