Abstract
This study, titled "Semantic Implications of Literal, Metaphorical, Explicit, and Implicit Expressions in Jurisprudence and Legal Systems," explores the fundamental linguistic and legal dimensions of textual indications. The primary objective is to demonstrate the significance of applying "Usul" (Principles of Islamic Jurisprudence) rules in interpreting statutory texts and extracting meanings from various verbal indications. The research framework begins with an introduction to the concept of "Signification" (Delalah) and its classifications. The first section examines the use of Literal (Haqiqah) and Metaphorical (Majaz) expressions, detailing their types, rulings, and the priority of application in the event of conflict. This is supported by practical applications within both Sharia jurisprudence and modern legal systems. The second section focuses on Explicit (Sarih) and Implicit (Kinayah) expressions, investigating their legal consequences and the intricate relationship between literal-metaphorical and explicit-implicit dichotomies. The study concludes that the rigorous application of these semantic rules is essential for precise legal interpretation, preventing arbitrary derivation of rulings, and ensuring that statutory texts align with their intended legislative objectives. The findings emphasize that integrating classical linguistic principles with modern legislative drafting is vital for achieving clarity and consistency in judicial and legal reasoning.
