بناء الإنسان في القانون المدني والفقه الإسلامي دراسة في الوسائل والأهداف

يتناول هذا البحث قضية بناء الإنسان بوصفها الغاية الكبرى من الوجود الإنساني، ويؤكد البحث أن اكتمال الإنسان في «أحسن تقويم» لا يتحقق إلا ضمن مشروع متكامل يوازن بين الجسد والروح، والفرد والمجتمع، والدنيا والآخرة. وتُبرز الدراسة فشل الفلسفات الوضعية التي حاولت بناء الإنسان بعيدًا عن الوحي، إذ عجزت عن تقديم نموذج إنساني متوازن، وانتهت في الغالب إلى تغليب البعد المادي أو النفعي على حساب القيم والمعنى. في المقابل، يثبت البحث أن المنهج الإسلامي، المنبثق من الوحي، هو المنهج الوحيد القادر على إيصال الإنسان إلى ذروة الكمال الإنساني الممكن، لما يتميز به من شمول وتكامل واتساق مع فطرة الإنسان. بخلاف المنظومات القانونية الوضعية التي تكتفي غالبًا بالتنظيم والإلزام، دون اعتبار عميق للبعد الأخلاقي أو الغائي للإنسان. كما يناقش البحث الآثار السلبية لقيم ما بعد الحداثة، التي أفرزت إنسانًا متمركزًا حول ذاته، منغمسًا في اللهو والاستهلاك والعوالم الافتراضية، ما أدى إلى ضياع روحي وانحدار قيمي متسارع. ويتطرق البحث إلى أخطر أزمة معاصرة تهدد كينونة الإنسان، المتمثلة في الدعوة إلى “الإنسآلة” أو الإنسان الآلي، والسعي لتجاوز الطبيعة البشرية بدعوى الكمال التقني، على الرغم مما يكتنف ذلك من إشكالات قانونية وأضرار أخلاقية ومآلات خطيرة على البشرية. ويؤكد أن مواجهة هذا المسار لا تكون إلا بإعلاء قيمة الإنسان وبيان سمو منزلته وكرامته. This study examines the issue of human development as the supreme purpose of human existence. It asserts that the realization of the human being in “the best form” can only be achieved through an integrated project that balances body and soul, the individual and society, and worldly life and the Hereafter. The study highlights the failure of positivist philosophies that sought to construct the human being independently of divine revelation, as they were unable to provide a balanced human model and often prioritized material or utilitarian dimensions at the expense of values and meaning.In contrast, the study demonstrates that the Islamic methodology, derived from revelation, is the only approach capable of elevating the human being to the highest attainable level of human perfection, due to its comprehensiveness, integration, and harmony with human nature. This stands in opposition to positivist legal systems, which tend to confine themselves to regulation and coercive enforcement without a profound consideration of the moral or teleological dimensions of the human being.The study also discusses the negative consequences of postmodern values, which have produced a self-centered individual immersed in entertainment, consumption, and virtual worlds, leading to spiritual loss and accelerated moral decline. Furthermore, it addresses the most critical contemporary crisis threatening human existence, namely the call for “post-humanism” or the mechanized human, which seeks to transcend human nature under the claim of technological perfection, despite the legal complications, ethical harms, and dangerous consequences it poses for humanity. The study emphasizes that confronting this trajectory is only possible by reaffirming the value of the human being and highlighting the nobility of human dignity and status.
