الحق في الخصوصية في ظل التحديات المعاصرة "دراسة فقهية"

يتناول هذا البحث الحق في الخصوصية في ضوء التحديات المعاصرة "دراسة فقهية"، وجاء البحث في مقدمة، ومبحثين، وخاتمة، أما المقدمة: فقد ذكرت فيها أهداف الموضوع، والأسباب التي أدت إلى اختيار الموضوع، ومنهج البحث، وخطة البحث. وجاء المبحث الأول بعنوان" تعريف الحق في الخصوصية في اللغة، والاصطلاح، وتناول المبحث الثاني الحقوق المتفرعة عن الحق في الخصوصية، أما الخاتمة فضمنتها أهم النتائج، ومنها صلاحية الشريعة الإسلامية للتطبيق في كل زمان ومكان، وبيان مدى عنايتها بالإنسان باعتباره الخليفة المسئول عن عمارة الأرض، ثم وضحت الحقوق المتفرعة عن حق الخصوصية في الإسلام، ومنها، حرمة المسكن، وحرمة التجسس، وحرمة الجسد، وحفظ الأسرار، وحرمة إفشائها، وأمرت الشريعة بالمحافظة على هذه الحقوق، كما بيت حرمة المسكن ، وجوب اتباع آداب الإسلام في دخوله، ونهت عن التجسس، وتتبع عورات الناس، بأي وسيلة من الوسائل؛ لما فيه من انتهاك حرمات الأفراد، وأمرت بتكريم الإنسان حيًّا، وميتًا، وحرمت الاعتداء على جسد الإنسان، وحرمت الخلوة بين الرجل الأجنبي، والمرأة الأجنبية، بأي طريقة من الطرق التي تتحقق بها الخلوة. ومن التوصيات التي توصلت إليها تعميق سبل الوعي بأهمية حقوق الإنسان، والمحافظة على خصوصياته، من خلال عمل برامج توعوية من خبراء مختصين من رجال الدين، والقانون في كافة الجهات، وتفعيل دور المؤسسات العلمية، والدينية، بتبصير الناس بأهمية الأخلاق والمحافظة عليها، وأهميتها في بناء الإنسان في ظل التحديات المعاصرة، والتوعية بأخطار وسائل التكنولوجيا التي غزت المجتمعات، والتركيز على الاستفادة من الجوانب الإيجابية منها في بناء الإنسان، ونهضة المجتمع، قيام الأسرة بدورها كاملاً عن طريق غرس قيم الأخلاق في نفوس الأبناء، وتعليمهم احترام خصوصيات غيرهم؛ لما له من نشر روح التعاون والمحبة بين أفراد المجتمع، تكاتف أبناء المجتمع بكل طوائفه في مواجهة الآثار السلبية للثقافات المعاصرة، التي طغت على خصوصيات الإنسان. This research deals with the Islamic approach to building humanity in light of contemporary challenges. The right to privacy in light of contemporary challenges is a “jurisprudential study” as an example, The research consisted of an introduction, two sections, and a conclusion. As for the introduction, I mentioned the importance of the topic, the reasons that led to choosing the topic, the research methodology, and the research plan. The first section was entitled “Defining the right to privacy in language and terminology, and the second section dealt with the rights deriving from the right to privacy. As for the conclusion, it contained the most important results, including the validity of Islamic law for application in all times and places, and a statement of the extent of its care for mankind as the caliph responsible for the construction of the earth, Then, the rights deriving from the right to privacy in Islam were clarified, including the inviolability of the home, the inviolability of spying, the inviolability of the body, the preservation of secrets, and the prohibition of divulging them, and the Sharia ordered the preservation of these rights, It also stipulates the sanctity of the dwelling, the necessity of following Islamic etiquette when entering it, and forbidding spying and tracking people’s private parts, by any means; Because it violates the sanctities of individuals, Islam ordered that humans be honored alive and dead, and forbade assault on the human body, It is forbidden to be alone between a foreign man and a foreign woman, by any means by which privacy can be achieved. Among the recommendations I reached is deepening awareness of the importance of human rights and preserving human privacy, through conducting awareness programs from specialized experts from the clerg, And the law in all areas, and activating the role of scientific and religious institutions, by informing people of the importance of morals and preserving them, and their importance in building the human being in light of contemporary challenges, and raising awareness of the dangers of the means of technology that have invaded societies, and focusing on benefiting from the positive aspects of them in building the human being, The renaissance of society means that the family fulfills its full role by instilling moral values ​​in the souls of children and teaching them to respect the privacy of others. Because of its ability to spread the spirit of cooperation and love among members of society, members of society from all sects joined together in confronting the negative effects of contemporary cultures, which have overshadowed human privacy.
