Abstract

Objectives: This study aims to shed light on the concept of an undertaking’s dominant position and to identify the prohibited practices associated with it under the Saudi Competition Law, as well as to clarify the scope of protection that the Law provides to competitors. Methodology: The study adopts an analytical approach to the relevant statutory provisions. In view of the limited availability of detailed and published judgments in this field within the Kingdom of Saudi Arabia, the study draws, where appropriate, on selected U.S. and European case law concerning the abuse of a dominant position, along with comparative law in certain parts of the study. Results: The study concludes that Article 6 of Competition Law, despite its importance in regulating the conduct of dominant undertakings, reveals certain deficiencies in some of its provisions, which may negatively affect the protection of competitors against exclusionary practices or abusive exploitation of market power. Conclusion: The study provides several recommendations, including reconsidering and redrafting certain provisions of Article 6 of the Competition Law in order to improve the legal framework governing dominant position and to enhance the protection of small undertakings from practices that violate the principles of fair and lawful competition by dominant undertakings.
