Abstract
Research reveals that we are not simply dealing with a set of emerging realities that can be addressed using traditional civil law tools. Rather, we are confronted with a clash between the traditional logic of law based on territorial sovereignty and material concepts, and the logic of code based on cryptographic sovereignty and decentralized virtual reality. Highlights the gap between theoretical framework of obligation and liability theories and immaterial nature of legal relationships in virtual worlds. It demonstrates how the concept of obligation has shifted from being a legal bond deriving its strength from the parties' will and judicial guarantees, to deterministic relationship governed by self-executing software code. This redefines the binding force of contracts and diminishes the judge's role as a balancing factor in contractual relationships. Furthermore, the research underscores the inadequacy of civil liability rules, both contractual and tortious, in providing definitive answers to new forms of harm and the difficulty of assigning fault in virtual environments. It became clear that the procedural rules representing the practical aspects of the judicial system -whether related to jurisdiction, evidence, or enforcement- are almost inflexible in the face of a reality characterized by impossibility, decentralization, and the disappearance of personal identity. This reality not only threatens the effectiveness of a specific legal rule but also the ability of the state's legal system to extend its sovereignty and protect rights within these new virtual spaces. A set of findings emerged, and the study concluded with a set of legislative and judicial recommendations.
