Abstract
The growing power of major technology companies poses a significant challenge to the national sovereignty of states, given their unprecedented ability to control individuals’ data, monitor them, and infringe upon their privacy, as well as their capacity to analyze individuals’ behaviors, choices, and preferences, and even predict them. More importantly, these companies have succeeded in collecting, processing, and storing personal data on a massive scale and for indefinite periods, thereby transcending national borders. This reality raises renewed questions regarding the very concept of national sovereignty in the digital age, as traditional borders are no longer sufficient to enable states to exclusively exercise their legislative, executive, and judicial powers over a defined territory and population. With the emergence of new actors capable of bypassing these borders, states have become increasingly unable to enforce their sovereignty, particularly in the field of personal data protection, in the face of the dominance exercised by major technology companies over this unbounded digital space.Based on the foregoing, this paper examines the extent to which guarantees of digital sovereignty are provided under the Saudi legal framework in confronting non-state digital actors, particularly foreign technology companies, and explores the possibility of achieving digital sovereignty over data in light of the Saudi Personal Data Protection Law. The paper concludes that the regulatory framework for personal data protection in the Kingdom continues to face numerous challenges that limit its effectiveness.
