Abstract

The future belongs to those who prepare for it and contribute to its creation.Foreseeing the future has become a fundamental focus of national progress due to the changes taking place in various aspects of life, the rapid technological development, and the widespread use of artificial intelligence in various aspects of life, particularly economic, commercial, and cultural activities, all of which are closely related to the legal system and inseparable from it.The legal system should not be isolated from modern technology.Rather, it must keep pace with evolving technological trends and modern information technology regulation through electronic litigation or electronic courts, where trials are conducted remotely.Electronic litigation, or remote litigation, is considered one of the most important developments in the technical aspect of justice. It has an effective impact on the speed and simplification of judicial transactions. However, this also requires a sophisticated legislative system that guarantees the protection of the rights of parties and the guarantees of a fair trial. The most significant problems of this research are the conflict between the principle of public hearings and the privacy of litigation via electronic means, as well as the lack of legislation that includes the concept of remote litigation and new legal terminology. However, the importance of the research lies in the serious challenges it poses to attempts to simplify and expedite the litigation process for litigants without compromising the principles of justice and the extent to which the latter is affected by the use of artificial intelligence or information technology. In this research, we address some of the legislative foundations for electronic litigation in civil transactions, reviewing the nature of electronic litigation and the components of the electronic court. We also discuss the systems for developing digital justice, both legislatively and practically, while explaining remote litigation procedures and notification methods in accordance with modern technological and technical developments. We also examine some legal systems for electronic notification in comparative legislation (French and Emirati). We also address developments in artificial intelligence and the compatibility between its use in digitizing the judiciary and ethical accountability I hope my research will be accepted.
