Marriage, divorce, and custody: The dynamics of women's rights in Islamic jurisprudence
Abstract
This research paper examines the complex dynamics of women's rights in the matter of marriage, divorce, and custody within Islamic jurisprudence. Based on the analysis of primary Islamic legal sources, including the Quran and Hadith, as well as the elucidations from various Islamic legal schools, the study explores how these rights are enunciated and practiced across different Muslim-majority countries. The paper delves into the fundamental aspects of marriage in Islam, highlighting the principles of mutual consent, the role of mahr (dower), and the evenness of rights and responsibilities between spouses. It further investigates the multidimensional processes of divorce, encompassing talaq (initiated by the husband), khula (initiated by the wife), and judicial divorce (faskh), and how these processes impact women's financial and social rights. Custody (hadanah) of children post-divorce is also scrutinized, focusing on the traditional and contemporary interpretations that prioritize the best interests of the child while considering the custodial rights of both parents. Through case studies from countries such as Egypt, Saudi Arabia, and Indonesia, the research highlights the practical challenges and successes in the implementation of women's rights within these legal frameworks. The study concludes by discussing the potential for legal reforms and the application of ijtihad (independent reasoning) to reconcile Islamic principles with international human rights standards, advocating for a more equitable legal system that enhances the rights and well-being of women in the Muslim world. This comprehensive exploration aims to contribute to a deeper understanding of the intersection between Islamic jurisprudence and women's rights, providing insights into on-going efforts and future pathways for legal and social reform.
