Abstract

The explosive Information and Communication Technology (ICT) development in India has revolutionized the society and simultaneously, has brought about a new arena of crime commonly referred to as cybercrime. This paper gives an in-depth discussion of cybercrime in India, its current legal system, classification of crimes, prevention, and emerging challenges. Based on the Information Technology Act 2000, Indian Penal Code 1860 and specialized laws dealing with cybercrimes, this study is able to synthesize the current empirical evidence and case laws to illustrate how digital crimes are constantly changing. A special focus is made on the topic of cybercrimes targeting women, the weaknesses of the current legal frameworks, and suggestions on how legal regulations can be strengthened [1]. The analysis indicates that more than 32,000 cybercrimes were reported in 2011-2015 in India of which 77 percent were registered in the specific IT Act provisions. The article is relevant to the academic discussion as it suggests a multidimensional strategy that involves legislative change, capacity building of an institution, and community awareness to deal with cybercrime in a holistic way. The study is specifically applicable to legal practitioners, policy-makers and academics who may be interested in the study of cyberlaw and digital security governance [2].
