Ensuring road safety in the context of proceedings in cases of administrative offenses
Abstract
The problem of ensuring road safety is one of the acute social, legal and organizational problems for modern society and the state. As technologies improve, new challenges arise, the localization of which requires significant efforts. The object of the study is social relations that arise when ensuring road safety. The subject of the study is the administrative-legal mechanism of proceedings in cases of administrative offenses in the field of road safety. The study was conducted using general scientific and special legal methods: comparative law, logical-legal, formal-logical, system-structural, formal-legal and others. It is indicated that the modern concept of administrative-jurisdictional activity of the National Police in the field of road safety should be based on the basic ideas of the Constitution of Ukraine, according to which a democratic state based on the rule of law is called upon to ensure the protection of the rights and freedoms and legitimate interests of man and citizen. The implementation of these principles entails new approaches to the content and practical implementation of the main provisions of administrative jurisdiction: compliance with the rule of law, equality of citizens and officials before the law, the inevitability of punishment, objective truth. This, in turn, entails the development of new aspects of the relationship between law enforcement agencies and citizens, in particular with patrol police officials, police station officers, community police officers, as well as with citizens as road users, based on the legislation on administrative offenses. It is noted that improving the level of road safety is impossible without increasing the effectiveness of the application of administrative legislation by patrol police officers, changing the powers of officials of the prevention service of the National Police, further improving the legislation regulating the use of technical means that ensure the law enforcement activities of the patrol police of the National Police, the organization of road traffic, as well as changes in the driver training system.
