Legal nature of a digital investment platform
Abstract
Financial technologies are currently actively and dynamically developing in Ukraine and in the countries of the European Union, which affects all spheres of state functioning, including economics and law. Financial technologies are a natural product of the new digital reality, in which the remote format of implementing the interaction of market entities confidently replaces traditional formats, which determines the relevance of the study. The object of the study was social relations that develop in the process of legal regulation of attracting investments using investment digital platforms. The subject of the study consists of legal norms that regulate activities in the field of attracting investments using investment digital platforms. The methodological basis was the dialectical method of cognition, general methods of formal logic and individual scientific methods: formal-legal, linguistic, comparative jurisprudence, etc. It is determined that an investment platform as a type of digital platform is a special object of legal regulation – an information system in the information and communication network of the Internet, which is used to make transactions using information and communication technologies between an unlimited number of participants in investment relations and acts as the operator of such a system, which performs the technical and technological function of an intermediary in the digital environment and has a special legal status. An investment digital platform by its legal nature is an organizational and legal means of state regulation of the economy, which allows considering the legal regulation of these platforms in a public-legal aspect. The state seeks to ensure a balance of private and public interests when regulating investment relations using investment digital platforms, providing additional guarantees to the consumer of financial services in the form of establishing requirements for investment platform operators on the basis of imposing obligations to protect public-legal interests on self-regulated organizations operating in a certain area of financial markets and investment platform operators.
