Abstract

The study analyzes the content and features of the legal status of migrant workers. The focus is on the regulatory regulation of the legal status of migrant workers and the mechanisms for ensuring their individual rights, which includes both national and international legal means. The key factors for protecting the rights of Ukrainians working abroad are identified and considered, which involves the state’s formation of comprehensive legal, socio-economic and cultural conditions for the implementation of their rights and freedoms, as well as the activities of national and international institutions designed to ensure proper protection of the interests of such persons. The main grounds and forms of control in the field of employment are determined, aimed at observing the law and guaranteeing the rights and freedoms of citizens. Practice confirms that work without proper legal registration, in particular without concluding an employment contract, is a serious violation of labor legislation not only for migrant workers, but also for all other categories of workers. The key guarantees that must be reflected in the employment contract are outlined, as well as a list of important information included in it, in particular, the terms of payment, working hours, labor protection and social security. Among the main challenges of labor migration, the need for Ukrainian workers to be oriented towards the norms of international law is emphasized, as well as the importance of a clear understanding of the legislation of which state regulates their labor, social and other guarantees. It is found that labor migration is a key component of modern international migration processes. The main motives that encourage citizens to go abroad are identified, especially in the context of Russian military aggression against Ukraine. Among the leading factors are the state of the domestic and external labor markets, the increased level of wages abroad, the stability of the economic and social system in the countries of employment, as well as the desire of Ukrainians to improve their material standard of living, gain new experience and professional skills that can be used in the future for the development of the domestic economy after returning home.
