Unification of international legal standards of responsibility for war crimes: the contribution of the International Criminal Court
Abstract
The article provides a characterization of key mechanisms for the unification of international legal standards of responsibility for war crimes through the lens of the International Criminal Court’s activities. Particular attention is paid to the historical evolution of international criminal law norms in the field of war crimes from the Nuremberg Tribunal to the contemporary ICC system. The article also includes an analysis of the relationship between the codification of war crimes in the Rome Statute and the practice of international judicial institutions and their impact on the formation of unified standards of criminal responsibility at the global level. It is substantiated that the effective functioning of the ICC system and the implementation of its standards into national legislation remain key factors in combating impunity for war crimes and an indicator of the level of development of international criminal justice. Special attention in the article is devoted to the relationship between the principle of complementarity enshrined in the Rome Statute and the process of harmonization of national legal systems in the field of prosecution of war crimes. The article also characterizes the role of the Elements of Crimes and the ICC’s jurisprudence in specifying the elements of war crimes and developing unified standards for their qualification. The influence of ICC jurisprudence on the development of customary international law and the practice of national courts in various jurisdictions is also analyzed. Emphasis is placed on the fact that ICC standards maintain universal and paramount importance at the present stage for ensuring fair justice for war crimes, and their strict application is a necessary condition for overcoming impunity, protecting the rights of victims of armed conflicts, and strengthening the rule of law in international relations. The article emphasizes the importance of implementing ICC standards into Ukraine’s national legislation, especially in the context of the ongoing armed aggression of the russian federation on the territory of our state, the continuing martial law regime, as well as the need to improve the national judicial system for effective prosecution of war crimes, strengthening cooperation with the ICC, and developing specialized mechanisms for documenting crimes. These issues are extremely relevant for ensuring justice and restoring the violated rights of victims of war crimes in Ukraine.
