Globalization as a factor in the transformation of the form of government of a modern state
Abstract
The article is devoted to the study of the influence of globalization processes on the form of government of a modern state. Globalization is considered as an objective trend of internationalization of various spheres of public life, which has a significant impact on the transformation of state and legal institutions, norms and relations at the global, macro-regional and intra-state levels. The large-scale modernization transformations of the second half of the twentieth century are analyzed, which led to the formation of a qualitatively new geopolitical configuration and led to the transition from a unipolar to a multipolar model of world development. Legal globalization is studied as a process of forming a global system of legal norms, in which international law, national law and the law of international economic associations are in a state of close interdependence. It is established that the universalization of the state and legal sphere is one of the key dimensions of globalization processes, which is manifested in the harmonization of national legislation with international standards and the recognition of the primacy of international law over national. The universal trends of deconcentration, decentralization and devolution, which are gaining particular relevance in the conditions of a globalized world, are considered. The formation of a “European constitutional model”, common to Western and Eastern European states, which encompasses the principles of constitutional order, provisions on the regulation of state institutions and norms in the field of protection of human rights and freedoms, is analyzed. The need to rethink the content and scope of the concept of the form of government of a modern state is substantiated, taking into account the mechanisms of interaction of national power institutions with supranational structures. Elements of the doctrinal assessment of the form of government in the conditions of globalization are identified, in particular the method of constituting public power, the participation of the people in granting powers to government bodies, the procedure for delegating sovereign rights to the supranational level and the role of the judiciary. The focus is on the problem of maintaining a balance between national and global interests as a key challenge for the modern state.
