Abstract

The article examines the legal characteristics of disciplinary proceedings in the National Police. The relevance of the topic is due to the special place of disciplinary responsibility among legal measures to ensure legality in police activities. The object of the study is the social relations that arise during disciplinary proceedings in the police. The subject is the administrative and legal norms that form the grounds and procedure for bringing police officers to disciplinary responsibility. In the course of the study, general scientific methods, specific methods of social sciences, and special methods of legal research were used. It is noted that the current level of development of the theory of administrative process and legislation on disciplinary responsibility allows us to consider proceedings in disciplinary cases of the police as a type of procedural activity and a structural element of the administrative process, the legal regulation of which is carried out by administrative procedural legislation. Proceedings in disciplinary cases as a structural element of the administrative process are a procedure regulated by procedural norms for the activities of the disciplinary authority regarding the initiation, consideration, and resolution of cases involving violations of official discipline by subordinate persons. The objectives of disciplinary proceedings in the National Police are: to consider and resolve, in accordance with the procedure established by the legislation on service in the National Police, individual cases of violations of official discipline by police officers; to prevent violations of official discipline and legality among the personnel of the National Police. It is stated that the system of principles for disciplinary proceedings in the police is based on the principles of disciplinary responsibility and the principles of administrative procedure and includes three groups of principles: general, jurisdictional, and special. An official investigation conducted within the framework of disciplinary proceedings should be considered as an optional type of procedural activity at the stage of establishing the facts of the case at the stage of initiating disciplinary proceedings.
