Abstract

The article is devoted to the study of modern legal aspects of public-private partnership in Ukraine in the context of recent changes in legislation, in particular the adoption of the Law of Ukraine «On Public-Private Partnership» No. 4510-IX of June 19, 2025. The article examines theoretical and legal approaches to defining the concept of public-private partnership, analyzes the evolution of the regulatory framework, and examines key novelties of the new law - expanding the subject composition of partnership, introducing an electronic trading system, simplifying procedures for small projects, hybrid financing, and improving investor protection mechanisms. The main principles, forms, implementation mechanisms, and problems of public-private partnership functioning in Ukraine are analyzed. Prospects for the development of legislation in the field of public-private partnership in the context of European integration and post-war reconstruction of Ukraine are determined. Special attention is paid to the legal aspects of public-private partnerships in the field of cybersecurity and the security sector, as well as the prospects for the use of public-private partnerships in the future. The European integration nature of the new legislation and the need for further improvement of law enforcement practice are confirmed. The conclusions emphasize the significant update of legal regulation and the formation of new mechanisms for interaction between the state and the private sector. The adoption of the new Law of Ukraine «On Public-Private Partnership» was an important step in reforming the system of attracting private investment and harmonizing national legislation with European standards. The modern model of public-private partnership is focused on ensuring the effective use of state and business resources for the implementation of socially significant projects, especially in the field of post-war reconstruction of Ukraine. The effective functioning of the public-private partnership system requires further improvement of legislation, increasing the institutional capacity of government bodies, ensuring transparency of procedures, and guaranteeing an adequate level of protection of investors’ rights.
