The Place of Prosecutorial Supervision in the Reform of the Judicial System According to the Judicial Statutes of 1864
Abstract
The judicial reform of 1864 became a key stage in the modernization of the judicial system of the Russian Em-pire and had a significant impact on the organization of legal proceedings and the activities of the prosecutor’s office. The article analyzes the place of prosecutorial supervision in the reformed judicial system, examines the transformation of its functions, the transition from an administrative-supervisory model to a procedural one, and the formation of the prosecutor’s prosecutorial role in criminal proceedings. Particular attention is paid to the challenges and contradictions encountered in the implementation of the prosecution’s new functions during the 1860s and 1870s, including personnel and organizational difficulties, continued dependence on the Ministry of Justice, and contradictions between the declared principles of reform and actual practice. The research is based on the analysis of Judicial Charters of 1864, normative acts of the Russian Empire, historical and legal literature of the pre-revolutionary, Soviet and modern periods. The results obtained allow for a deeper under-standing of the patterns of formation of the institution of prosecutorial supervision and identify the historical grounds for modern discussions about the limits and directions of prosecutorial activity.
