Abstract

The article examines the formation and classification of branches of law. Particular attention is paid to the prob-lems of complex branches of law. The author notes the lack of a consolidated approach to understanding the content of a branch of law and the classification of branches of law in legal theory and specialized disciplines. There is currently a pressing need for a clear definition of the level of autonomy that would allow a branch of law to be considered not simply a structural element, but an “independent” branch, as opposed to a “complex” one. As a result of this research, the author concludes that issues related to the formation of new branches in the Russian legal system require comprehensive consideration through fruitful interdisciplinary dialogue involv-ing specialists in legal theory and specialized disciplines for the progressive development of Russian higher education, legal scholarship, and the legal system as a whole.
