The balance between artificial intelligence and judge's inner conviction in judicial reasoning
Abstract
In a period when artificial intelligence is being rapidly integrated into our lives, one of the main questions that remains open for employees working in the judiciary is: in the future, could artificial intelligence replace judges? Within the framework of the research, the decisionmaking processes of artificial intelligence and judges are compared from the perspective of the rule of law, procedural justice, and the legitimacy of decisions, highlighting the strengths and weaknesses of each. Subsequently, the legal and practical consequences of a decision being made by artificial intelligence versus being based on a judge's internal conviction are analyzed. Additionally, the study examines the extent to which artificial intelligence is already being used in the court practices of some countries and provides relevant examples. In conclusion, it is emphasized that the collaboration between the judicial system and artificial intelligence is significant both in terms of saving time and as a complementary model for making more accurate and just decisions.
