Abstract
The article is devoted to the problem of classification of persons providing legal assistance to convicts. Having conducted a comprehensive analysis of the current legislation of the Russian Federation regulating the provision of legal aid, using a retrospective analysis of Article 48 of the Constitution of the Russian Federation and penal enforcement legislation, the authors concluded that there is a legal gap in Part 8 of Article 12 of the Penal Code of the Russian Federation regarding the definition of the circle of «other persons entitled to provide legal assistance». Based on the analysis of the opinions of modern researchers in the field of law and the analysis of legislation, the authors have deduced the characteristics of persons providing legal assistance to convicts and also proposed the author's classification of persons providing legal assistance to convicts.
