Abstract

In this article, the issue of recognizing digital rights as a separate group of human rights, their fourth generation, is examined through the study of the main arguments in favor of this approach. The analysis of the views of Russian researchers on this issue allowed the authors to identify four main groups of arguments in favor of the need to recognize digital rights: 1) the specific properties of the virtual, digital environment and its dissimilarity to the social environment, including the possibility of ensuring greater human freedom from interference by individuals, state institutions, and public organizations; 2) the impossibility of regulating relations in the new environment using conventional means; 3) the emergence of new rights in the full sense of the word, the protection of which is a vital necessity and has social and legal value; 4) the riskiness of the virtual environment, which requires the protection of human rights and interests by the state. Speaking about the main arguments of those who oppose the recognition of a new group of human rights, the authors agree that there is no need to talk about the emergence of truly new rights, as the essence of the rights and their content remain the same. They share the position of those who, while recognizing the specific nature of modern sociality, raise the issue of changing the ways and means of realizing and protecting human rights, rather than the need to recognize a new group of rights.
