Sigorta Bilgi ve Gözetim Merkezinin Hukuki Statüsü ve İdari Teşkilat İçerisindeki Yerinin Değerlendirilmesi

This article seeks to determine the legal status of the Insurance Information and Monitoring Center and its position within the administrative organization. It is considered that such a definition is necessary both for doctrine and judicial bodies. After providing a general explanation of the differing views regarding the classification of legal entities in Turkish administrative law and of our administrative organization in general, the legal nature of the Insurance Information and Monitoring Center and its place within the administrative structure are evaluated in light of these explanations. First, the relevant legislation has been examined, and the provisions concerning the establishment, duties, and powers of the Center set forth in the legislation are explained. Subsequently, the assessments contained in judicial decisions regarding the legal nature of the Insurance Information and Monitoring Center and its place within the administrative organization have been examined. The fact that judicial decisions do not contain a concrete determination concerning the legal personality and organizational position of the Center further underlines the importance of the determination to be made. Thereafter, from the perspective of administrative law theory, the legal status regulated in the legislation has been evaluated, and the place of the Center, which we determined to be a public legal entity, has been defined within the administrative organization. In this context, taking into consideration that the Center was established under the Association of the Insurance, Reinsurance, and Pension Companies of Türkiye, it has been discussed, whether it can be characterized as a "subordinate public professional organization" or a "secondary public professional organization" under functionally decentralized organizations, and it has been concluded that it is essentially a "public institution".
