Abstract

Indonesia has ratified the TRIPs Agreement through Law Number 7 of 1994 concerning the Ratification of the Agreement Establishing the World Trade Organization, which also incorporates the TRIPs Agreement. As a consequence of this ratification, Indonesia is required to harmonize its legal system with TRIPS standards. One form of such legal harmonization is the regulation of Geographical Indications under Law Number 20 of 2016 concerning Trademarks and Geographical Indications. However, despite the legal recognition of Geographical Indications under this law, their implementation in practice still faces various challenges. These include limited public awareness of Geographical Indications, inadequate management capacity of Geographical Indication Protection Communities (MPIG), insufficient government support, inadequate regulatory frameworks and legal protection, obstacles in marketing and commercialization, as well as the limited capacity of Geographical Indication holders to supply and scale up production in response to market demand.
