Abstract

In the context of Chile’s proposed decarbonization of the energy matrix and its commitment to a just transition, the rulings of Chilean environmental courts on renewable energy projects approved in the Environmental Impact Assessment System (SEIA) that affect indigenous communities are analyzed, to identify whether there are environmental justice gaps in their decisions. The research focuses on the normative tension between decarbonization and the human rights of indigenous communities, suggesting that these should be considered in the environmental assessment process.
