Abstract

The article is devoted to the study of legal regulation and practical application of mediation in Greece. The concept and essence of mediation are defined, which consists in the settlement of conflicts (disputes) between the parties by peaceful means with the participation of a professional, impartial and neutral mediator -a mediator. It is found that the institution of mediation was first implemented in the national legal system of Greece after the transposition of Directive 2008/52/EC of the European Parliament and of the Council by adopting Law No. 3898/2010 «On mediation in civil and commercial disputes».It is determined that Law No. 3898/2010, despite the low level of public interest in mediation, laid the institutional and professional foundations for the development of mediation: a system of training and accreditation of mediators was formed, a number of scientific studies were conducted, and organizations capable of providing mediation were created.Particular attention is focused on the analysis of the current Law No. 4640/2019, which defines in detail the terminological apparatus, as well as other important aspects related to the legal status of the mediator, the features of conducting mediation, its documentation, etc.It was found that, unlike Ukrainian legislation, Law No. 4640/2019 provides for two types of mediation: voluntary and partially mandatory, which provides for the mandatory holding of the first (initial) mediation session. The categories of civil and commercial disputes in which partially mandatory mediation is used are determined. The role of lawyers in mediation at the regulatory and practical levels is analyzed. The conclusion is made about the increased attention of the Greek legislator to the active introduction of mediation as an alternative out-ofcourt method of conflict (dispute) resolution, which has a number of undeniable advantages compared to the judicial process. It is determined that it would be useful for the Ukrainian legal system to borrow the experience of Greece in: the introduction of partially mandatory mediation, determining the participation of lawyers in mediation.
