Abstract

This article examines the peculiarities of the legal status of certain categories of individual debtors under martial law and their impact on the application of bankruptcy procedures.Particular attention is paid to the specific legal position of internally displaced persons, Ukrainian citizens who have gone abroad, military personnel, as well as persons subject to sanctions. An analysis of judicial practice demonstrates the emergence of new approaches to determining territorial jurisdiction in bankruptcy cases involving internally displaced persons, the difficulties in proving a debtor's income earned abroad and the need to take into account the special status of military personnel, which complicates the performance of certain procedural actions. The article separately examines the conflict between the provisions of the Code of Ukraine on Bankruptcy Procedures and the Law of Ukraine "On Sanctions," which manifests itself in the blocking of a debtor's assets and restrictions on their economic activity. It is emphasized that the imposition of sanctions does not constitute grounds for refusing to initiate bankruptcy proceedings, although further consideration of the case must be carried out with due regard to the applicable restrictive measures. The article concludes that there is a need for legislative regulation of the interaction between the Code of Ukraine on Bankruptcy Procedures and sanctions legislation, as well as the introduction of special procedural safeguards for military personnel. The results of the study indicate that martial law has heightened the need to improve the institution of personal insolvency, particularly by taking into account current socio-economic realities, ensuring a balance between the interests of creditors and debtors, and preserving the priority of national security.
