SYSTEM OF MEASURES TO PROMOTE THE EMPLOYMEN OF PEOPLE WITH DISABILITIES IN UKRAINE

У статті з'ясовано, що складовою соціального захисту, економічної самостійності та соціальної інтеграції осіб з інвалідністю є їхня зайнятість.Проаналізовано співвідношення права на працю та права на сприяння зайнятості.Встановлено, що право на сприяння зайнятості є суб'єктивним правом, основним завданням якого є втілення у життя права на працю.Досліджено положення міжнародних актів щодо застосування термінів «сприяння зайнятості» та «заходи сприяння зайнятості».Запропоновано авторське визначення терміну «заходи сприяння зайнятості осіб з інвалідністю».Критично проаналізовано норми Закону України «Про зайнятість населення» від 05.07.2012 р. № 5067 щодо заходів сприяння зайнятості осіб з інвалідністю.Актуалізовано перелік заходів сприяння зайнятості осіб з інвалідністю, які закріплено у Законі № 5067, зокрема до таких належать: 1) стимулювання працевлаштування осіб з інвалідністю; 2) заходи щодо підвищення конкурентоспроможності осіб з інвалідністю; 3) компенсація фактичних витрат за облаштування робочих місць/місць провадження господарської діяльності/незалежної професійної діяльності для осіб з інвалідністю.Виокремлено можливі причини низької ефективності таких заходів сприяння зайнятості.Здійснено комплексний аналіз проекту Стратегії зайнятості населення України на період до 2030 року.Досліджено законодавчі зміни до Закону України «Про основи соціальної захищеності осіб з інвалідністю в Україні» від 21.03.1991р. № 875, запроваджені після набрання чинності Законом України «Про внесення змін до деяких законодавчих актів України щодо забезпечення права осіб з інвалідністю на працю» від 15.01.2025 р. № 4219, що стосуються заходів сприяння зайнятості осіб з інвалідністю.Аргументовано, що заходи сприяння зайнятості осіб з інвалідністю хоча й закріплені на нормативному рівні, однак умови та порядок реалізації визначені лише щодо окремих із них, що свідчить про фрагментарний характер правового регулювання та ускладнює практичне застосування відповідних норм.Ключові слова: зайнятість, заходи сприяння зайнятості, особи з інвалідністю, роботодавець, працівник, ринок праці, стимулювання працевлаштування, заходи щодо підвищення конкурентоспроможності, компенсаційні виплати.The article clarifies that employment is a component of social protection, economic independence, and social integration of persons with disabilities.The relationship between the right to work and the right to employment promotion is analyzed.It is established that the right to employment promotion is a subjective right, the main task of which is to implement the right to work.The provisions of international acts regarding the use of the terms "employment promotion" and "employment promotion measures" are examined.The author's definition of the term "measures to promote the employment of persons with disabilities" is proposed.The provisions of the Law of Ukraine "On Employment of the Population" dated July 5, 2012, No. 5067, regarding measures to promote the employment of persons with disabilities have been critically analyzed.The list of measures to promote the employment of persons with disabilities, which is enshrined in Law No. 5067, has been updated, in particular to include the following: 1) encouraging the employment of persons with disabilities; 2) measures to improve the competitiveness of persons with disabilities; 3) compensation for actual expenses incurred in equipping workplaces/places of economic activity/independent professional activity for persons with disabilities.Possible reasons for the low effectiveness of such employment promotion measures have been identified.A comprehensive analysis of the draft Employment Strategy of Ukraine for the period up to 2030 was carried out.Legislative amendments to the Law of Ukraine "On the Fundamentals of Social Protection of Persons with Disabilities in Ukraine" dated March 21, 1991, No. 875, introduced after the entry into force of the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine Regarding the Right of Persons with Disabilities to Work" dated January 15, 2025, No. 4219, concerning measures to promote the employment of persons with disabilities.It is argued that although measures to promote the employment of persons with disabilities are enshrined at the regulatory level, the conditions and procedure for their implementation are defined only for some of them, which indicates the fragmentary nature of legal regulation and complicates the practical application of the relevant norms.
