Abstract

The article provides a comprehensive philosophical and legal analysis of the relationship between morality and law within the context of the Ukrainian legal tradition through the prism of the typology of rationality. The methodological framework of the study is based on historicalphilosophical, hermeneutic, and comparative legal approaches, which made it possible to trace the evolution of interpretations of the interaction between moral and legal norms across different stages of social development in Ukraine. It is substantiated that morality and law function as fundamental social regulators whose dialectical interaction in various historical epochs determined the nature of legal culture, the level of legitimacy of state authority, and the state of legal consciousness in society. It is demonstrated that the specificity of Ukrainian legal development lies in its stable orientation toward a value-based naturalistic model of rationality, within which law has traditionally been perceived not merely as a system of formal norms but as a bearer of justice, moral imperatives, and universal human meanings.Based on an analysis of the key historical stages -from Kyivan Rus and the Lithuanian-Polish period to the Cossack-Hetman era, imperial rule, the Soviet period, and contemporary independent Ukraine -the article reveals the transformation of types of rationality (classical, value-based, instrumental, institutional, communicative, and postmodern) and outlines their influence on the nature of the interaction between morality and law.It is shown that periods of loss of statehood and authoritarian governance were accompanied by the dominance of formal-legistic and instrumental rationality, which led to the alienation of law from the moral consciousness of the population and a decline in public trust in legal institutions.Particular attention is paid to the Cossack-Hetman period as a historical example of a relatively harmonious moral and legal synthesis, as well as to the current stage of Ukraine's development, which is characterized by a complex search for a balance between the value content of law, institutional effectiveness of the state, and the communicative participation of civil society in law-making and law-enforcement processes. The article concludes that further legal reforms in Ukraine should be based on restoring the organic unity of morality and law as a necessary prerequisite for strengthening the rule of law, ensuring human rights, and forming a democratic state governed by the rule of law in accordance with European standards.
