Abstract

The article defines the grounds for disciplinary liability of judges, taking into account their legislative regulation, and identifies problems of their interpretation in law enforcement practice. It has been established that, by content and essence, the grounds for holding a judge accountable for disciplinary liability can be systematized into the following groups: 1) violation of procedural norms and deadlines -illegal denial of access to justice, unjustified delay in considering the case (beyond the established deadlines), violation of the rules of automated case distribution, failure to indicate the reasons for accepting or rejecting the arguments of the parties; 2) violation of ethical norms and incompatibility -behavior that discredits the title of a judge or undermines the authority of justice, extra-procedural communication regarding the circumstances of the case, failure to notify of a conflict of interest, violation of requirements for declaring income/expenses; 3) failure to fulfill professional duties -unjustified dismissal from office of another judge or inaction, which led to significant consequences, violation of the principles of equality of parties or the right to a fair trial; 4) the presence of intentcommitting a misdemeanor intentionally (conscious violation), committing a misdemeanor due to negligence (unconscionable attitude to duties). The problems of interpreting the grounds for disciplinary liability of judges in Ukraine are identified, which are associated with the vagueness of legislative formulations, the subjectivity of disciplinary bodies and the conflict between the need to punish for misdemeanors and ensuring judicial independence, with difficulties in interpreting evaluative concepts («substantial violation», «gross neglect of duties»), which creates risks of pressure on judges and violation of the principle of predictability. It is proposed to systematize the practice of the High Council of Justice in interpreting the grounds for disciplinary liability of judges in the form of a generalization of such practice, which would serve as a safeguard for judges and other participants in the judicial process against deviation from lawful behavior and adherence to the principles of proper judicial proceedings.Key words: disciplinary liability of judges, grounds for disciplinary liability of judges, composition of a disciplinary offense, objective side of a disciplinary offense, judicial ethics.
