Abstract

The article provides a comprehensive criminal law analysis of the subject matter of the intentional unlawful destruction, demolition, or damage of cultural heritage objects or their constituent parts. It is substantiated that the correct determination of the subject matter of the criminal offense is of fundamental importance for establishing the corpus delicti, distinguishing it from related criminal offences, and ensuring effective criminal law protection of cultural heritage. The provisions of criminal legislation and Ukrainian laws in the field of protection of cultural and archaeological heritage are analysed, as well as the positions of domestic scholars concerning the possibility of recognising as the subject matter of the crime individual parts of a cultural heritage object, movable items originating from archaeological heritage sites, cultural property, and newly discovered cultural heritage objects. It is demonstrated that the subject matters of the crimes provided for in Parts 2-5 of Article 298 of the Criminal Code of Ukraine are exclusively cultural heritage objects, namely monuments of local or national significance. It is concluded that cultural property, as well as movable items originating from archaeological heritage sites, do not constitute cultural heritage objects and therefore cannot be recognised as the subject matters of the crimes stipulated in Parts 2-5 of Article 298 of the Criminal Code of Ukraine. The article proposes directions for improving the criminal law provision, in particular by clarifying the dispositions of Parts 2-5 of Article 298 of the Criminal Code of Ukraine with regard to the criminal law protection of monuments of local and national significance, as well as newly discovered cultural heritage objects.Proposals to criminalise the intentional destruction or damage of cultural property are supported.Emphasis is placed on the expediency of maintaining the existing legal terminology in the field of cultural heritage protection when drafting provisions of the new Criminal Code that will establish criminal liability for encroachments on cultural heritage.
