Abstract

The article is devoted to a comprehensive analysis of the legal nature of virtual assets in Ukraine through the prism of its legislative consolidation and research of judicial practice. The authors analyze various approaches to the formation of a conceptual and categorical framework, ranging from the definition of a virtual asset as an «intangible asset» in the relevant law to the latest concept of a «digital thing» enshrined in the Civil Code of Ukraine and the promising European integration Draft Law No. 10225-d.The article focuses on the problem of «dormant» legislation, in particular the Law «On Virtual Assets», which, due to the lack of tax regulation and non-compliance with the MiCA Regulation, requires a fundamental review even before it enters into force. It has been proven that the fragmentation of the regulatory field forces courts to act as «pioneers», independently determining the legal regime of cryptocurrency (cryptoassets) within the framework of civil and criminal proceedings. The authors pay particular attention to the analysis of existing case law in Ukrainian criminal proceedings on the classification of virtual assets as the subject of criminal offenses under Article 185 of the Criminal Code of Ukraine ( theft), Article 189 of the Criminal Code of Ukraine (extortion), Article 190 of the Criminal Code of Ukraine (fraud), Article 200 of the Criminal Code of Ukraine (illegal actions with documents for transfer, payment cards and other means of access to bank accounts, electronic money, equipment for their manufacture), Article 209 of the Criminal Code of Ukraine (legalization (laundering) of proceeds obtained by criminal means), Article 368-5 of the Criminal Code of Ukraine (illegal enrichment), or recognition as a means under Part 1 of Article 110-2 of the Criminal Code of Ukraine (financing of actions committed with the aim of changing the territory and state border of Ukraine in violation of the procedure established by the Constitution of Ukraine) or as material evidence.Considerable attention is paid to the study of procedural challenges regarding the specifics of imposing seizure on cryptocurrency (crypto assets). The authors conclude that overcoming legal uncertainty is only possible through the final implementation of the MiCA Regulation and clear identification of assets in court decisions (wallet addresses, UID).The article contains recommendations for improving legislative techniques to ensure the effectiveness of criminal proceedings and the protection of the rights of digital market participants.
