TACTICAL ASPECTS OF A SPECIALIST’S PARTICIPATION IN INVESTIGATIVE (SEARCH) ACTIONS DURING THE INVESTIGATION OF THE DESTRUCTION OR DAMAGE TO FLORA OBJECTS

У статті досліджено тактичні аспекти участі спеціалістів у проведенні слідчих (розшукових) дій під час досудового розслідування кримінальних правопорушень про знищення або пошкодження об'єктів рослинного світу, відповідальність за які передбачена статтею 245 Кримінального кодексу України.Актуальність обраної тематики зумовлена суттєвим загостренням екологічних загроз в Україні, зокрема внаслідок збройної агресії, техногенних аварій, пожеж, а також поширенням випадків умисного й необережного випалювання рослинності, що спричиняє значну шкоду довкіллю.Проаналізовано стан наукової розробленості проблем використання спеціальних знань у кримінальному провадженні та встановлено, що питання тактики участі спеціалістів у слідчих (розшукових) діях під час розслідування екологічних кримінальних правопорушень залишаються недостатньо дослідженими.Особливу увагу у статті приділено нормативному регулюванню порядку залучення спеціалістів відповідно до положень Кримінального процесуального кодексу України та відомчих нормативно-правових актів, а також їх участі у слідчих (розшукових) діях.Встановлено, що залучення спеціалістів до проведення слідчих (розшукових) дій у кримінальному провадженні про знищення або пошкодження об'єктів рослинного світу здійснюватися за порядком виклику слідчим, відповідно до норм Кримінального процесуального кодексу України, при чергуванні спеціалістів у складі слідчо-оперативної групи, листом керівника органу досудового розслідування або постановою про залучення спеціаліста.Розкрито особливості участі у слідчих (розшукових) діях спеціалістів-криміналістів, пожежників, екологів, операторів безпілотних літальних апаратів залежно від конкретних обставин кримінального правопорушення.Визначено основні завдання спеціалістів на різних етапах розслідування, форми їх взаємодії зі слідчим, а також тактичні прийоми виявлення, фіксації, вилучення та попереднього дослідження слідової інформації.Зроблено висновок, що ефективне залучення спеціалістів і належна тактика їх участі у слідчих (розшукових) діях сприяють підвищенню повноти, об'єктивності та результативності досудового розслідування кримінальних проваджень про знищення або пошкодження об'єктів рослинного світу.Ключові слова: знищення або пошкодження об'єктів рослинного світу, розслідування кримінального правопорушення, слідчі (розшукові) дії, тактика, спеціаліст.The article examines the tactical aspects of the participation of specialists in conducting investigative (search) actions during the pre-trial investigation of criminal offenses of destruction or damage to objects of the plant world, liability for which is provided for by Article 245 of the Criminal Code of Ukraine.The relevance of the selected topic is due to the significant aggravation of environmental threats in Ukraine, in particular as a result of armed aggression, man-made accidents, fires, as well as the spread of cases of deliberate and careless burning of vegetation, which causes significant damage to the environment.The state of scientific development of the problems of using special knowledge in criminal proceedings is analyzed and it is established that the issues of the tactics of participation of specialists in investigative (search) actions during the investigation of environmental criminal offenses remain insufficiently researched.The article pays special attention to the regulatory regulation of the procedure for involving specialists in accordance with the provisions of the Criminal Procedure Code of Ukraine and departmental regulatory legal acts, as well as their participation in investigative (search) actions.It is established that the involvement of specialists in conducting investigative (search) actions in criminal proceedings on the destruction or damage of objects of the plant world should be carried out in accordance with the procedure for calling an investigator, in accordance with the norms of the Criminal Procedure Code of Ukraine, when specialists are on duty as part of the investigative and operational group, by a letter from the head of the pre-trial investigation body or by a resolution on the involvement of a specialist.The features of participation in investigative (search) actions of forensic specialists, firefighters, ecologists, and drone operators depending on the specific circumstances of the criminal offense are revealed.The main tasks of specialists at different stages of the investigation, the forms of their interaction with the investigator, as well as tactical methods for detecting, recording, extracting and preliminary studying trace information are determined.It was concluded that the effective involvement of specialists and the appropriate tactics of their participation in investigative (detective) actions contribute to increasing the completeness, objectivity, and effectiveness of pre-trial investigation of criminal proceedings regarding the destruction or damage to flora objects.
