Abstract
The article is devoted to a comprehensive study of topical issues of interrogation with the participation of children in criminal proceedings of Ukraine. The author analyzes the legal regulation of the specifics of interrogation of minors and juveniles in accordance with the current Criminal Procedure Code of Ukraine, taking into account the changes made in fulfillment of the state's international obligations.International standards for conducting procedural actions involving children have been studied, in particular, the provisions of the UN Convention on the Rights of the Child, the Council of Europe Convention on the Protection of Children against Sexual Exploitation and Sexual Abuse (Lanzarote Convention), and the Guidelines of the Committee of Ministers of the Council of Europe on Child-Friendly Justice.Particular attention is paid to the analysis of special methods of interrogating children, in particular the «Green Room» methodology and the «Barnahus» model, which are aimed at minimizing the negative impact of criminal proceedings on the child's psyche and preventing secondary traumatization. The procedural guarantees for the protection of children's rights during interrogation are considered, including the mandatory participation of a legal representative, teacher or psychologist, limitations on the duration of interrogation, and the specifics of warning about liability for false testimony. The judicial practice of the Criminal Court of Cassation within the Supreme Court regarding the assessment of the admissibility of children's testimony obtained using various interrogation methods has been analyzed. The main problems of law enforcement in the field of interrogating children have been identified, including insufficient material and technical resources for implementing special methods, the need to improve the qualifications of investigators, prosecutors and judges on issues of developmental psychology and communication with children.Proposals have been formulated for improving legislation and law enforcement practice in the field of interrogating children in criminal proceedings, including legislative consolidation of the mandatory use of special methods when interrogating child victims of certain categories of crimes, expanding the network of specially equipped premises based on the «Barnahus» model, introducing mandatory specialized training for law enforcement officials and judges who conduct proceedings involving children.
