UN NORMATIVE MECHANISMS REGARDING COURTERING TERRORISМ: DEVELOPMENT IN MODERN CONDITIONS
Abstract
The article states that understanding the content, structure, system and prospects for the evolution of universal international legal standards in the field of countering terrorism is most in demand for domestic legal doctrine and practice in the context of the rapid devaluation of democratic institutions in some key countries of the world, in terms of the widest possible application of the category of «terrorism» in the information and political space. At the same time, aspects of assessing UN documents in the field of countering terrorism have not yet been reflected in modern scientific works of domestic scientists, moreover, these documents have undergone significant development over the past three years. Therefore, in the article, the author determines the international legal significance of modern UN documents in the field of countering terrorism, the organizational mechanisms of their formation and evolution. To this end, the article conducts a chronological, comparative, formal-legal, systemic and hermeneutic analysis of these documents, assesses the principles of development and implementation of relevant UN acts and their place in the system of sources of modern international law.The article reveals the content and consistent implementation of the 2006 UN Global Counter-Terrorism Strategy and resolutions of the UN General Assembly, as well as acts of the UN Secretary-General regarding the observance of human rights while combating terrorism. The author proves that UN standards in the field of counter-terrorism are embodied in a series of resolutions of the General Assembly, which, among other things, contribute to the activities of individual UN special rapporteurs and the reporting of the Secretary-General.These standards have a clearly expressed programmatic and regulatory nature and are developing in a situation where the imperative requirements of international law on countering terrorism are embodied in specialized conventions, but the approval of a comprehensive treaty on countering terrorism is clearly not on the current agenda, at least in the activities of the UN.
