PROTECTION OF THE RIGHTS OF THE CHILD IN THE DIGITAL ENVIRONMENT WITHIN THE COUNCIL OF EUROPE SYSTEM
Abstract
Finland, Söderman v. The article is devoted to the analysis of international legal standards for the protection of the child's rights in the digital environment through the lens of European regional practice (with a specific focus on the Council of Europe standards and the pertinent jurisprudence of the European Court of Human Rights). It argues that the rapid digitalization of society, intensified by the COVID-19 pandemic and the realities of armed conflict in Ukraine, has transformed the ways in which children learn, socialize and express themselves, while at the same time significantly increasing risks to their privacy, safety and psychological integrity. The article substantiates the approach according to which «digital» rights in question do not constitute a separate category of rights but rather represent a contemporary dimension of human rights already enshrined in international law.Various theoretical approaches to defining the digital environment are explored. Particular attention is paid to the analysis of GeneralComment No. 25 of the UN Committee on the Rights of the Child, as well as to the standards of the Council of Europe, including Recommendation CM/Rec(2018)7, the Lanzarote Convention and the Budapest Convention.A central place in the study is occupied by the case law of the European Court of Human Rights, which makes it possible to specify the content of States' positive obligations in the digital environment.By examining the cases of K.U.v. Finland, Söderman v. Sweden and Volodina v. Russia (No. 2), the article demonstrates the evolution of the Court's approach to the protection of children and other vulnerable persons from online violence, unlawful collection and dissemination of personal data, covert digital recording and cyberstalking. The article concludes that States, taking into account the practice of the ECHR, are obliged to ensure not only effective investigation of violations in the digital sphere, but also preventive protection of children's rights through the adaptation of domestic legislation to contemporary technological challenges.
