COMPULSORY PERFORMANCE, MODIFICATION, AND TERMINATION OF LEASE AGREEMENTS AS REMEDIES FOR THE PROTECTION OF RIGHTS
Abstract
The article examines legal remedies available to the parties in lease contractual relationships. It is argued that such remedies include: declaration of invalidity of the contract; specific performance (compulsory fulfillment of obligations); modification and termination of the legal relationship; compensation for damages and other forms of pecuniary redress; recognition of the absence of a right or corresponding obligation; recognition of ownership rights; and transfer of the rights of the lessee or buyer. The article substantiates that, given the legal nature of lease agreements, the remedy of specific performance has limited applicability and primarily concerns the failure to fulfill or the improper performance of core obligations, such as the transfer of the leased property by the lessor, the payment of rent, and the return of property after the lease period. For the breach of other obligations, different legal remedies explicitly provided by law are more appropriate, while the use of specific performance may be regarded as an improper or ineffective remedy.Particular attention is paid to the enforcement of the return of leased property, with detailed analysis of claims concerning both movable and immovable property and the nuances of their compulsory enforcement within the framework of enforcement proceedings. It is noted that the recommendations presented apply not only to specific performance but also to the annulment of contracts with restitution, termination of lease agreements with the return of the leased object, and negatory claims in cases of non-concluded or void lease contracts. The article concludes that, considering the special legal status of certain parties or objects within lease relationships, the law provides for the possibility of terminating lease obligations even in the absence of a breach. This serves, in particular, to protect the weaker or socially vulnerable party to the agreement.
