Challanges faced by current system of administration of justice in India dealing with the rights of Migrated Women
Abstract
The Indian justice system faces significant challenges in addressing the rights of migrated women, largely due to socio-economic, legal, and procedural barriers. Firstly, linguistic and cultural differences create communication gaps and hinder access to legal information and services. Migrated women often lack awareness of their rights and the judicial processes, exacerbating their vulnerability. Socio-economic constraints, such as poverty and lack of stable employment, limit their ability to seek legal recourse and support. Additionally, the existing legal framework often fails to account for the specific needs of these women, lacking adequate provisions and protections. Procedural delays and the overburdened judiciary further impede timely justice. Bureaucratic hurdles and corruption within the system also deter migrated women from pursuing legal action. Moreover, patriarchal norms and societal stigma often discourage them from reporting crimes or seeking justice. The absence of a robust support system, including legal aid and counseling services, further aggravates their plight. Addressing these challenges requires a multifaceted approach, including legal reforms, increased awareness, and the establishment of comprehensive support systems to ensure the protection and empowerment of migrated women.
