Implementasi Pencegahan Perkawinan Anak Berdasarkan Peraturan Daerah Provinsi Nusa Tenggara Barat Nomor 5 Tahun 2021
Abstract
This study examines the implementation of child marriage prevention based on Regional Regulation of West Nusa Tenggara Province No. 5 of 2021 as a regional legal instrument to strengthen child protection. Using normative legal research with a conceptual and statutory approach, the study analyzes primary, secondary, and tertiary legal materials through library research and descriptive qualitative analysis. The findings show that prevention strategies are carried out through two main pathways: judicial prevention via marriage dispensation as a judicial control and ultimum remedium, and community-based prevention through capacity building for children, supportive environments, improved access to services, regulatory and institutional strengthening, and stakeholder coordination. Supporting factors include the establishment of the Regional Regulation, village regulations, and the development of community-based child protection forums. However, implementation still faces challenges from cultural traditions of early marriage, economic constraints, and limited community understanding of child rights. The study concludes that the success of child marriage prevention in West Nusa Tenggara depends on regulatory synchronization, institutional reinforcement, active child participation, and multi-sector collaboration, accompanied by continuous efforts to change societal mindsets. These findings imply that comprehensive and consistent approaches are required to reduce child marriage rates and improve human resource quality in the region.
