Safeguarding environmental human rights by eradicating greenwashing through genuine corporate sustainability in India
Abstract
India's fast-paced economic development has worsened environmental problems, making environmental human rights protection an urgent necessity. However, emergence of greenwashing vis-a-vis deceptive environmental claims has compromised the real efforts of sustainability and endangered these rights. This study examines the relationship between greenwashing, corporate sustainability, and environmental human rights in the Indian context. Using a mixed-methods approach through legal analysis, review of data, and mathematical modeling, the study incorporates legal frameworks, quantitative evidence, and case studies to ascertain the efficacy of existing regulations and propose strategies for eradicating greenwashing. Mathematical modeling is used to quantify the relationship between regulatory strength, greenwashing prevalence, and human rights outcomes. Results show that greenwashing characteristics are widespread among the National Stock Exchange Fifty or NIFTY 50 companies, with a higher concentration in manufacturing and energy sectors. Marginalized communities, especially Scheduled Castes (SCs) and Scheduled Tribes (STs), suffer significantly higher levels of damage to their environmental human rights. The mathematical model depicts increase in regulatory enforcement associated with greenwashing prevalence decrease (being an exploratory association rather than a validated causal effect) across the states analyzed. Significance of having strong legal enforcement, transparent reporting, third party verification, and stakeholder engagement to ensure that corporate sustainability initiatives actually protect environmental human rights is promoted by the findings.
