Duas reflexões sobre o sistema de justiça multiportas
Abstract
This article presents two reflections on the Brazilian Multi-Door Justice System. The first questions the distorted use of self-composition as a response to structural deficiencies in the Judiciary, which undermines its original purpose. The second highlights the system’s democratic potential by allowing greater individual protagonism in building conflict solutions. The central hypothesis is that the system’s effectiveness lies in the adequacy between the dispute resolution method and the nature of the conflict, not in its instrumentalization. The methodology is theoretical-deductive, based on literature review, normative analysis, and a hermeneutic reading of Kafka’s parable “Before the Law”. It concludes that the multi-door model, when guided by the principle of adequacy, strengthens participatory justice and the Democratic Rule of Law.
