La Acción Extraordinaria de Protección como medio de Derecho Procesal Constitucional
Abstract
The Extraordinary Action for Protection (AEP) enacted by Article 94 of the Ecuadorian Constitution, establishes a constitutional mechanism to protect fundamental vulnerabilities through legal instruments. This study analyzed the law, jurisprudence and legal doctrine in the case of Yessenia Paola Iza Pilataxi who was arbitrarily prosecuted by the Archidona Fire Department. In Judgment No. 292-16-SEP-CC the Constitutional Court Commission declared widespread discrimination and ordered comprehensive compensation, thus prioritizing the AEP from the perspective of human justice. This study compared the AEP with Venezuela's appeal and concluded that the AEP provides the best and most lasting protection for Ecuador, the result was that the AEP reaffirmed constitutional sovereignty, the role of the court, and equal access to justice. We conclude that its future depends on systematic and differentiated application, guided by the general protection of humanity under the rule of law.
