Abstract
The article is devoted to current scientific, legal and practical problems of a relatively new interdisciplinary institution - non-procedural appeals, with an emphasis on the specifics of filing, reviewing and publicizing these appeals in criminal proceedings. As part of a comprehensive analysis of legal doctrine and law enforcement practice, the authors present the idea that one of the most significant achievements of the rule of law is an independent court, whose functioning is ensured through the use of an effective state mechanism that protects against any form of unlawful interference in the activities of the court in the administration of justice. At the same time, attention is focused on the fact that today the institution of non-procedural treatment is a problematic factor that has not been legally worked out due to conceptual disagreements in the scientific community, but is rapidly developing due to the digitalization of all forms of government and public activities. In the process of writing the article, the authors conducted a sociological study that made it possible to identify current aspects and problems of non-procedural appeals: the unjustifiability of recognizing as such any appeals filed with the court; the prospects for excluding from the list of non-procedural those appeals that contain threats against judges, jurors, the chairman of the court, the deputy (deputies) of the court, with their referral to law enforcement agencies; the allocation of a special group of non-procedural appeals - namely, appeals of the chairman of the court, the deputy chairman of the court, and judges who are not considering the case to the judges who are considering the case. Taking into account the current situation, the importance of forming a fundamentally new scientific view of this legal phenomenon is emphasized, involving an assessment of its impact on the independence, objectivity and impartiality of judges; awareness of the need to maintain the authority of the judiciary and strengthen public confidence in it.
