Debtor’s liability for obstructing enforcement of debt from mortgaged real estate
Abstract
This article argues that individuals often take out loans by pledging their own or other individuals’ real estate. If a loan secured by real estate is not repaid within the agreed-upon period, the situation becomes complicated. In order to enforce the obligations of the debt from the mortgaged property, the creditor (claimant) is forced to apply to court. Upon the plaintiff’s application, the court passes a verdict to foreclose on the defendant’s mortgaged property to enforce the obligations. If the defendant fails to voluntarily repay the loan, the ruling is subject to compulsory enforcement, and the debt is recovered from the mortgaged property. In this article, we examine the debtor’s liability under the law for obstructing enforcement proceedings.
