Abstract

The author’s view The preferential provisions contained in the Third Party (Rights against Insurers) Act which allow the transfer of the ownership of the indemnity right claimed by the insured to the injured third party are inapplicable if the compensation is paid before the latter goes into liquidation. In this case, in fact, unless otherwise provided by the contract or by statutory provisions, the injured third party has no choice but to invoke the validity of an implicit clause, or rather, of a trust in his favor. On this point, a recent ruling by the prestigious Lord Matthews, subsequently upheld by the Court of Appeal, provides an opportunity to examine English precedents regarding implied terms, implied trusts, and constructive trusts.
