Abstract
The author’s view This contribution examines the role of the notarially authenticated digital copy, preserved in compliance with statutory requirements, as a potential means of public notice for long-term trusts, which lack a dedicated system of public disclosure. It argues that the notary, through the centralized preservation system pursuant to Article 62-bis of the Notarial Law, may become, from an evolutionary perspective, the institutional custodian of fiduciary intent, ensuring the long-term accessibility of documents even beyond the notary's professional life. This form of compliant digital preservation, currently limited to specific cases, may thus represent a new frontier of the notarial function in safeguarding legal certainty.
