Abstract
The author’s view The decree issued by the Court of Sulmona presents a significant drawback: the assumption that the beneficiary will be a forced heir entirely excluded from testamentary provisions. This assumption seems unacceptable because, at most, an “after us” testamentary trust only causes damage to the legitimate heir. Therefore, the request for authorization to refrain from bringing a legal action against the testamentary trust appears unusual. From both a logical and legal standpoint, it would be more appropriate to seek authorization on behalf of the trust beneficiary. This would involve waiving the right to pursue a reduction action after accepting the inheritance, which consists of the entire or a portion of the assets allocated to the testamentary trust.
